Neck pain after a rear-end collision

After a rear-end collision, many people experience both physical and psychological symptoms. Neck pain is one of the most common complaints. This so-called “classic whiplash” occurs when a vehicle is hit from behind, causing the occupant’s neck to move rapidly — like the motion of a whip — forward, backward, or sideways.

Common symptoms of whiplash include:

  • Neck pain
  • Back pain
  • Headaches
  • Stiffness
  • Difficulty concentrating

Within 24 hours after the accident, other symptoms may also develop, such as:

  • Muscle pain
  • Fatigue
  • Tingling in the arms or hands
  • Dizziness
  • Nausea or vomiting
  • Anxiety
  • Sleep problems

The type and severity of symptoms vary from person to person. It’s important to take these complaints seriously. Always seek medical examination — even if symptoms appear later. This not only supports your recovery but is also essential for successfully claiming your personal injury compensation.

he added value of Kracht! Letselschade lies in our personal attention and dedicated service. After an injury, there’s often more possible than you might think.

Who is liable in a rear-end collision?

In almost all rear-end collisions, the driver of the rear vehicle is considered at fault and therefore liable for the accident. This is based on Article 19 of the Dutch Road Traffic and Signs Regulations (Reglement Verkeersregels en Verkeerstekens), which states that drivers must keep a sufficient distance to prevent accidents:

“A driver must be able to bring their vehicle to a stop within the distance they can see and that is clear.”

However, there are a few exceptions where the front vehicle may be (partially) liable for the damages:

  • If the front vehicle braked suddenly without a valid reason
  • If the front vehicle cut off the rear vehicle
  • If the rear vehicle was pushed forward by another vehicle — in other words, during a chain collision
