In most rear-end collisions, the driver of the rear vehicle is at fault and therefore liable for the accident. This is based on Article 5 of the Dutch Road Traffic Act and Article 19 of the Traffic Rules and Signs Regulations, which state that drivers must keep a safe distance to avoid collisions.
There are only two exceptions — when the front vehicle:
- Brakes suddenly without reason, or
- Cuts off another vehicle.
In these cases, the front driver may be held liable for the damage.
Hit while cycling
Different liability rules apply when cyclists are involved in accidents. Here’s an overview of who is responsible in various situations:
1. Hit by a car while cycling
If you were hit by a car while cycling, the driver of the motor vehicle is almost always (partially) liable — even if you made a mistake yourself. Under Article 185 of the Dutch Road Traffic Act, vulnerable road users such as cyclists are legally protected.
In most cases, the car’s insurer must pay at least 50% of your damages. If you were not at fault, the insurer must cover 100% of your losses, including personal injury and compensation for pain and suffering.

2. Hit by a moped or scooter while cycling
If you were hit by a moped or scooter, the rider is usually liable. These vehicles are considered motor vehicles under Dutch law, meaning cyclists receive extra legal protection as vulnerable road users.
In most cases, the moped or scooter rider must compensate for at least part of your damages.
Only if you made a serious traffic error — for example, running a red light — could this affect the amount of compensation. Still, you often remain entitled to compensation, so it’s important to have your situation properly assessed and guided by experts.
3. Hit by another (electric) cyclist
If you were hit by another cyclist, liability depends on who caused the accident. The standard rules for civil liability apply. If the other cyclist is at fault, they are responsible for covering your damages.
When both parties share some degree of fault, the compensation may be divided proportionally based on the level of responsibility.
